Governor's Position and Role

(1) As the Constitutional Chairman of the Executive

  • The Governor is the constitutional head of the executive of the State.
  • Due to parliamentary rule, the Governor is the nominal head of the Executive.
  • Article 163 (i) "Except where the Governor is required by the Constitution or under the Constitution to act in his discretion, there shall be a Council of Ministers to aid and advise the Governor in discharging his functions."
  • It is clear from this Article that in addition to the discretionary powers, the Governor is in the position of the Constitutional head of the Executive, who has to perform administrative functions in consultation with the Council of Ministers
  • (2) More than the Constitutional Head

  • According to KM. Munshi "In some circumstances the Governor can act in a very beneficial and effective manner."
  • According to MV Peeley, the following are the opportunities for the discretionary powers of the Governor
